Terms and Conditions of Logistique Laurentides
1. Introduction
These terms and conditions (hereinafter referred to as "Conditions") govern the use of the delivery and logistics services offered by Logistique Laurentides. By using our services, you fully accept these Conditions.
2. Definitions

Client: Any business using the services of Logistique Laurentides.

Goods: Any item, product, or material entrusted to Logistique Laurentides for transportation and delivery.

Service: All transportation, delivery, warehousing, and other related services provided by Logistique Laurentides.
3. Liability and Limitations

Responsibility of Logistique Laurentides: We are committed to transporting your goods with care. However, our liability for loss or damage is limited to the declared value of the goods or an amount equal to the replacement cost, whichever is lower, unless otherwise agreed in writing between the parties.

Limitation of Liability: Logistique Laurentides is not responsible for indirect losses, including loss of profit, revenue, business, or customers.

Force Majeure: Logistique Laurentides shall not be held responsible for any delays or failures due to events beyond its reasonable control, such as natural disasters, labor disputes, acts of terrorism, or technical issues beyond our control.
4. Client Obligations

Accuracy of Information: The client must provide accurate and complete information regarding the goods, including their dimensions, weight, and any specific characteristics requiring special attention. Any inaccuracies may result in additional fees or suspension of the service.

Packaging: The client must ensure that the goods are properly packaged to withstand normal transport conditions. Logistique Laurentides will not be responsible for damage resulting from inadequate packaging.

Legal Compliance: The client guarantees that the goods comply with applicable laws, particularly concerning hazardous or regulated materials.
5. Payment

Payment Terms: All invoices must be settled within 7 days from the date of issuance. An initial deposit of 45% is required for service contracts, payable within 7 days of the contract signing. Monthly payments begin 30 days after the start of operations.

Late Payment Penalties: In case of late payment, interest of 1.5% per month will be applied to the outstanding amount. If the delay exceeds 30 days, Logistique Laurentides reserves the right to suspend services until payment is made.

Additional Fees: Additional fees may be charged for extra services or modifications requested by the client after transportation has begun.
6. Claims

Claim Deadline: Any claims for loss, damage, or delay must be submitted in writing within 120 days from the date of shipment.

Claim Procedure: Claims must be accompanied by documentary evidence, and if necessary, the damaged goods must be made available for inspection. Claims processing is conditional upon full payment for the services.
7. Service Modifications and Cancellations

Rate Changes: We reserve the right to adjust our rates and service conditions based on market needs. Any changes will be communicated to the client prior to implementation.

Service Cancellation: Services may be canceled by the client with a written notice of 90 days. Cancellation fees may apply if the notice period is not respected. Specific cancellation conditions are outlined in each service contract.
8. Data Confidentiality and Security

Data Protection: We are committed to protecting the confidentiality of personal and business information you provide to us. This information is used solely for the provision of our services and will not be shared with third parties without your consent, unless required by law.
9. Governing Law and Jurisdiction

Governing Law: These Conditions are governed by the laws of the province of Quebec.

Dispute Resolution: In the event of a dispute, the parties will make every effort to resolve the matter amicably. Failing that, the competent courts of the province of Quebec shall have exclusive jurisdiction.
