Logistique Laurentides Damage Policy
1. Introduction
This Damage Policy (hereinafter referred to as "Policy") governs claims, liabilities, and limitations related to damages incurred by goods during their transportation by Logistique Laurentides. By using our services, you agree to the terms of this Policy.
2. Limitation of Liability

Limited Liability: Logistique Laurentides’ liability for damage, loss, or destruction of goods is strictly limited to the declared value of the goods or the maximum amount of [insert amount], whichever is lower. If no declared value has been provided, liability is limited to [insert reasonable amount] per kilogram of damaged, lost, or destroyed goods.

Exclusion of Indirect Damages: Logistique Laurentides shall not be liable for any indirect, special, punitive, or consequential damages, including but not limited to loss of profit, revenue, business, or customers, even if such damages were foreseeable or Logistique Laurentides had been informed of the possibility of such damages.
3. Force Majeure
Logistique Laurentides shall not be held responsible for damages or losses caused by events beyond its reasonable control, such as:

Natural disasters (storms, floods, earthquakes).

Acts of war, terrorism, or sabotage.

Strikes, labor disputes, or other work stoppages.

Communication or network system failures.
4. Exclusions of Liability
Logistique Laurentides shall not be liable for damages or losses caused by:

Inadequate or defective packaging provided by the client.

The client’s failure to follow Logistique Laurentides’ instructions regarding the preparation, labeling, or documentation of goods.

The perishable, fragile, or hazardous nature of goods that was not communicated to Logistique Laurentides in advance.
5. Inspection and Claims

Inspection Requirement: The client or recipient must inspect the goods upon delivery and immediately report any visible damage to the carrier. Failure to do so will constitute unconditional acceptance of the goods as delivered in good condition.

Claim Deadline: All claims for damage, loss, or delay must be submitted in writing within 120 days from the date of shipment. Any claims submitted after this period will be deemed null and void.

Claim Procedure: To process a claim, the client must provide a detailed description of the damage, photographic evidence, and all relevant invoices or documents. Logistique Laurentides reserves the right to inspect the damaged goods before accepting or denying a claim.
6. Insurance Coverage
Logistique Laurentides strongly recommends that clients purchase additional insurance to cover the full value of the goods being transported, especially if their value exceeds the liability limitations set out in this Policy. Logistique Laurentides can provide insurance services upon prior request, subject to additional fees.
7. Waiver
Any failure by Logistique Laurentides to enforce or exercise any right or provision of this Policy does not constitute a waiver of that right or provision.
8. Modifications
Logistique Laurentides reserves the right to modify this Policy at any time. Any changes will be communicated to the client and will apply to services rendered after the Policy's update date.
9. Governing Law and Jurisdiction
This Policy is governed by the laws of the province of Quebec. In the event of a dispute, the parties agree to submit to the exclusive jurisdiction of the competent courts of the province of Quebec.
